DUI cases

  • According to police, defendant loses control and overturns his truck. His passenger is ejected and killed. The defendant has a blood alcohol level nearly twice the legal limit and has been smoking marijuana. Defendant confesses to police. Sentencing guidelines are for 12 years Florida State Prison. McDonald and Shearer challenge accident investigation procedures. Defendant pleads to a non-alcohol felony for probation and no jail.

  • Defendant charged with a DUI in Winter Haven. Review of police reports shows a name unrelated to the case. Defense counsel researches the unrelated name and discovers that deputy wrote the exact same observations for both defendants on field sobriety tasks. This discovery of the deputy’s conduct ultimately results in the dismissal of 54 DUI cases by the State Attorney’s Office.

  • Defendant charged with DUI manslaughter in Winter Haven. Multiple discrepancies in accident investigation discovered by McDonald and Shearer. The defendant received no jail and 2 years house arrest instead of 12 years Florida State Prison.

  • Defendant charged with DUI manslaughter on County Line Road. She had alcohol in her system but under legal limit. Accident causation also questioned by McDonald and Shearer. Entire case dismissed.

  • Defendant charged with Polk County DUI. Two deputies investigate the case. At motion hearing, officers challenged on their recollections and inconsistencies in their reports. Court prohibits the key officer from testifying at trial and entire case dismissed.

Felonies

  • Defendant charged with 40 counts of possession of child pornography by Sheriff’s Office. Defendant bonds out and gets rearrested for witness tampering. All pornography charges dismissed, defendant enter best interest plea to misdemeanor charges of improper use of a computer and disorderly conduct. Defendant receives no jail and short period of probation. Defendant not a sex offender or a felon.

  • Defendant charged with capital sexual battery facing mandatory life in prison. Defendant denied charges. Case resolved with misdemeanor plea and a short period of probation. Defendant not a sexual offender or a felon.

  • Defendant arrested for filling a forged prescription for 240 Oxycodone pills. Defendant identified by pharmacist as person who obtained the drugs. Investigation revealed defendant to have an alibi.  Lack of forensic evidence and questionable actions by the pharmacy resulted in dismissal of all charges.

  • Defendant charged with sexual battery and extortion facing prison for the rest of his life. Research by McDonald and Shearer counsel revealed that the “victim” had a history of drug abuse and total lack of credibility. All charges dismissed.

  • Defendant charged with drug trafficking after informant advises law enforcement of several vehicles loaded with marijuana. Informant to receive $16,000.00 for his information. Research by McDonald and Shearer showed informant totally lacking in credibility who made multiple misrepresentation to law enforcement. Defendant plead to misdemeanor charge for probation and no jail.  The $16,000.00 was not given to the informant but used to pay informants ex-wife for back child support, alimony, and attorney fees.
